China is leading the race in generative AI patents, significantly outpacing other nations, including the United States, according to a report by the United Nations. The World Intellectual Property Organization (WIPO), which oversees the global patent recognition system, revealed that China has filed six times more patents in this burgeoning field than the U.S., its closest rival.
Generative AI is a rapidly expanding technology that creates text, images, computer code, and music from existing data. Over the past decade, more than 50,000 patent applications for generative AI have been filed worldwide, with 25% of those filed in 2023 alone. This surge underscores the explosive growth and increasing significance of this technology.
“This is a booming area, growing at increasing speed. And it’s somewhere that we expect to grow even more,” said Christopher Harrison, WIPO Patent Analytics Manager, during a press briefing.
Between 2014 and 2023, China filed over 38,000 generative AI patents, compared to the United States’ 6,276. These Chinese patent applications span a wide range of sectors, including autonomous driving, publishing, and document management. South Korea, Japan, and India rank third, fourth, and fifth, respectively, with India showing the fastest growth rate in generative AI patent filings.

Prominent companies among the top applicants include China’s ByteDance, the owner of TikTok, the Chinese e-commerce giant Alibaba Group, and Microsoft, which supports OpenAI, the creator of ChatGPT.
Chatbots capable of mimicking human conversation are already widely used in retail to enhance customer service. However, the potential applications of generative AI extend far beyond this. Harrison highlighted that generative AI could revolutionize many economic sectors, including science, publishing, transportation, and security. For instance, in the scientific sector, AI-created molecules could significantly speed up drug development.
“The patent data suggests this is an area that is going to have a profound impact across many different industrial sectors going forward,” said Harrison, emphasizing the transformative potential of generative AI.
WIPO anticipates another wave of patent filings soon and plans to release future updates on the data, potentially using generative AI to illustrate these trends.
This dominant position in generative AI patents places China at the forefront of a technology poised to reshape numerous industries. As global interest and investment in generative AI continue to rise, the innovations stemming from these patents will likely play a critical role in driving technological advancements and economic growth worldwide.
