The shutdown, which the company stated was “effective immediately,” comes amid ongoing tensions between X’s owner, Elon Musk, and Brazilian Supreme Court Judge Alexandre de Moraes over the platform’s responsibility to counter disinformation.
While Brazilian users will still have access to the platform, the closure of its operations marks a significant escalation in the conflict between X and the Brazilian judiciary. The company expressed deep regret over the decision, attributing the shutdown entirely to the actions of Judge Moraes. “We are deeply saddened that we have been forced to make this decision,” X stated, pointing out that the responsibility “lies solely” with Moraes.
The legal confrontation between X and Moraes has been brewing for some time. The judge, who presides over Brazil’s Superior Electoral Tribunal, has been a vocal advocate for combating online disinformation, particularly in the wake of the 2022 Brazilian presidential election. Moraes has ordered X to block accounts accused of spreading false news and hate speech, many of which were linked to supporters of former President Jair Bolsonaro. Bolsonaro, a far-right figure, had repeatedly made unsubstantiated claims about the vulnerability of Brazil’s electronic voting system, which fueled tensions and mistrust during the election period.
The aftermath of Bolsonaro’s defeat by left-wing President Luiz Inacio Lula da Silva saw a violent outburst from Bolsonaro’s supporters, who stormed key government institutions in a failed attempt to overturn the election results. These events underscored the dangers of disinformation and the role of social media platforms in either mitigating or exacerbating such risks. Moraes, in his capacity as a judge, has maintained that “freedom of expression doesn’t mean freedom of aggression,” emphasizing that it does not extend to the defense of tyranny.
However, the relationship between Moraes and Musk has been fraught with tension. Earlier this year, Moraes ordered X to take down content and block accounts spreading harmful misinformation. According to X, the situation took a severe turn when the judge allegedly threatened to arrest one of the company’s legal representatives in Brazil, Rachel Nova Conceicao, if the platform did not comply with his orders. The company published images of a document purportedly signed by Moraes, which stipulated a daily fine of 20,000 reais (approximately $3,653) and an arrest order for Conceicao if X failed to remove certain content.
The Brazilian Supreme Court, when approached by Reuters, declined to comment on the document’s authenticity, neither confirming nor denying its validity. This lack of clarity has added to the already charged atmosphere surrounding the issue.
Elon Musk has not held back in his criticism of Moraes, labeling him “an utter disgrace to justice” in a social media post on Saturday. Musk defended the difficult decision to shut down X’s operations in Brazil, arguing that complying with the judge’s demands would have been untenable and “there was no way we could explain our actions without being ashamed.”
The tensions between Musk and Moraes escalated earlier this year when Moraes initiated an inquiry into Musk after the billionaire announced plans to reactivate accounts that the judge had previously ordered blocked. Although X initially resisted the rulings, its representatives eventually assured Brazil’s Supreme Court that they would comply with the legal decisions, attributing any failure to fully implement the blocks to “operational faults.”
This shutdown marks a significant moment in the ongoing global debate over the balance between freedom of speech and the regulation of disinformation on social media platforms.
